Today is a good day for Habeas Corpus and the rule of law.
Posted 9 weeks 5 days ago byToday the US Supreme Court voted ( 5 to 4 ) to grant terrorism suspects held since 6 years , in Guantanamo Bay without specific charges or trial, access to Federal Courts in accordance to Habeas Corpus.
Justice Kennedy was the swing vote on the court.
Of course the conservatives on the Court ( Including the two Pres. Bush's nominees, Justice Roberts and Alito)were dissent votes on the case.
Senator McCain's reaction to the vote was very much in line with the one of the Bush Administration.
Sen. McCain, while on the campaign trail, said: " They are unlawful combatants, they are not American citizens and I think we should pay attention to Justice Roberts' opinion in this decision " Referring to Justice Roberts' dissent on the case.
Well, the US constitution could apply again for the Executive Branch.......at least towards the end of Pres. Bush's 2nd term.

Bush is calling for his head because of the "torture" at gitmo! Come on, most are living better and longer lives at gitmo than they were in Afghanistan. The only torture may be in is the mental anguish over being physically unable to blow themselves up.
This is the problem. The die hard Pres Bush haters would have gone nuts if he actually followed the Laws of Armed Conflict just like they (you) are going nuts because he didn't.

Our "friends", presumably European Socialist nations, were happy to vote to pass meaningless UN resolutions and be 'on the take'in the oil for food program. President Bush and Congress added teeth to the UN, captured Sadaam Hussein (no relation), captured or killed hundreds of terrorists.
Frankly, our "friends" don't have the capability or the political will (was going to use "balls") to do much but perpetuate corruption and their own power.
While I don't agree with the Iraq decision, I do respect someone for keeping their word and doing what needs to be done. In my opinion, U.S foreign policy (although wrong) showed a distinct contrast in handling the situation.
So if by "new direction", you mean someone that shares a vision with Socialist nations about expanding government power and play nice/do nothing politics, you are right. Our "friends" don't like to look bad.
It's just a matter of time until reality slaps the naive smile off the hope, change and yes we can people.

Bushco is so incompetent. If they had killed these suspects on the spot, or kept them in Pakistan, nobody would have said a word, or known a thing about it. But these geniuses had to bring them over to Gitmo, torture them for minimal information, and then show-trial them just for "s**ts and giggles"

This is just one more glaring ways Pres Bush mishandled the GWOT. Pres Bush is the one that said they would be treated as lawful combatants.
Ulnawfull Combatants are not protected by the Laws of Armed Conflict (erroniously refered to as the Geneva Convention) and since its inception have most often been tried by the local military authority and executed on site.
